1. Heard.

2. This is the First Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicants who have been arrested on 07.08.2020 in connection with Crime No.60/2020 registered at Police Station Kunkuri, District Jashpur (CG) for the offence punishable under Sections 326 (A), 34 IPC.

3. As per the prosecution case, on 05.08.2020 the applicants who are the fatherin-law & mother-in-law of the complainant Geeta Bai, they attacked Geeta Bai and splashed acid on her over a family dispute.

4. Learned counsel for the applicants submits that on the date of incident, the sudden provocation erupted because of the quarrel in between the children and there was no intention of the applicants and apart from that no past dispute exists in the family of the applicants. He refers to the affidavit sworn by the complainant herself and her husband that they have no objection if the bail is granted to the applicants, therefore, the applicants may be released on bail.

5. Per contra, learned State counsel opposes the prayer for grant of bail.

6. Considering the statement of the complainant and the way the offence has been committed and it is a case of acid attack, I am not inclined to release the applicants on bail.

7. Accordingly, the bail application is dismissed. SD/Sd/- Goutam Bhaduri Judge Ashu
