1. Heard.

2. The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.449/2019 registered in Police Station Dabhra, Janjgir-Champa C.G. for the offence punishable under Sections 363, 366A, 376 of the I.P.C. & Section 6 of the Protection of Children from Sexual Offences

MCRC No. 5974 of 2020 Act, 2012.

3. Case of the prosecution, in brief, is that applicant has abducted and committed forcible sexual intercourse with the prosecutrix aged about 13 years.

4. Learned State counsel would oppose the prayer for grant of bail.

5. Considering the age of the prosecutrix, no case for grant of bail is made out.

6. Accordingly, the bail application is rejected, however, reserving liberty in favour of the applicant to revive the prayer after examination of the prosecutrix.
