The applicant has preferred this application for grant of bail as she is arrested in connection with Crime No.356/2008 registered in Police Station Champa, Distt. Janjgir-Champa (CG) for offence punishable under section 498-A, 494, 506, 34 of Indian Penal Code. 2.

As per the prosecution case, a report was made on 5/12/2008 that prior to 2 1⁄2 years complainant Uttara Kumari was married to Hem Kumar Sahu and thereafter she was subjected to torture for demand of dowry. Applicant Sumita Bai is the sister-in-law (Jethani) of complainant and general allegation for demand of dowry has been levelled against her. 3.

Learned counsel for the applicant submits that charge sheet was filed and the applicant had gone out to earn their livelihood, before four months charge sheet was filed and she is in jail since 27/05/2016, no further evidence is required, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail.

Perused the case diary and the documents. Considering the facts and circumstances of the case, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on her furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for her regular appearance before it as and when directed.
