Ignoring the defaults pointed out by the Office in the present Writ Petition, the matter was finally heard at admission stage itself with the consent of learned Counsels for the parties.

Grievance of Petitioner seems to be the granting of first time scale pay with effect from 1.4.2006.

Learned Counsel for Petitioner referring to Annexure P-1, dated 21.5.2013, submits that the Government itself has found the Petitioner becoming eligible for the benefits of time scale pay from 3.3.2001, however, Annexure P-1 shows that the benefits have been extended to Petitioner only from 1.4.2006. Learned Counsel for Petitioner further submits that the Petitioner has been repeatedly approaching asking the Respondent Authorities as to why he is not being paid the benefits from 3.3.2001 as per Annexure P-1, dated 21.5.2013, but there is no response from the Respondent - State authorities.

Given the limited grievance that Petitioner has, the present Writ Petition at this juncture is disposed of directing Respondent No.2 to take an appropriate decision on the representation of Petitioner as regards his claim for grant of time scale pay from the date he became eligible for the same that is from 3.3.2001 onwards instead of 1.4.2006. 5.

Let Respondent No.2 take an appropriate decision in this regard in terms of the policy, circulars and the orders of the State Government so far as the grant of time scale pay is concerned, at the earliest, preferably within a period of 90 days from the date of receipt of copy of this Order. 6.
