Hon'ble Shri Justice Goutam Bhaduri Order 16.09.2020 Heard.

1. The present petition is against the order dated 24.07.2020 passed by the Sub Divisional Officer (R), Podiuproda, Korba, District Korba under Section 44 of the Chhattisgarh Land Revenue Code, 1959 (hereinafter referred to as 'the Code, 1959') while hearing the first appeal.

2. Section 44 (2) of the Code, 1959 provides that the second appeal would lie against the order passed in the first appeal. Therefore, when the statutory alternative remedy of filing second appeal is available, I am not

inclined to exercise the power under Article 226 of the Constitution of India and the petitioner may file the second appeal, if so advised.

3. The certified copy of the order Annexure P-1 be returned to the petitioner after retaining photocopy of the same.
