The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.29/2016 registered in Police Station Balrampur, District-Balrampur-Ramanujganj (C.G.) for offence punishable under sections 420, 379 r/w 34 of Indian Penal Code and Section 4(B), 9 and 10 of the C.G. Saarvajanik Pariksha (Anusuchit Sadhano Ka Nivaran) Adhiniyam 2008.

As per the prosecution case, a report was made on 18/03/2016 that Vikrant Malakar has received an information on his mobile on whatsapp that Shivam is in possession of class 9th and 11th papers which were to be held and conducted by Madhyamik Shiksha Mandal are available at the rate of Rs.1000/-. Subsequently, on enquiry made it was found that applicant who was In-charge of K.D.S. School has permitted the accused Ashraf to take out paper which was established from the statement of Rijvan.

Learned counsel for the applicant submits that nothing in this case
is available to show that applicant has authorised other co-accused Ashraf to take out paper. He submits that even if applicant has been implicated and it is not clear wherefrom question had leaked out, charge sheet has been filed, no further evidence is required, the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Perused the case diary and the documents. Taking into degree of allegation, without further observation on merits, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
