1. The grievance of petitioner in the present writ petition seems to be the action on the part the respondents who have found respondent no.7 qualified for appointment to the post of Constable (General Duty).

2. The contention of the learned counsel for petitioner is that the petitioner is more meritorious than respondent no.7 in all respects, therefore the respondents ought to have considered the case of petitioner ahead of respondent no.7. It is the further contention that even at the time when the petitioner was subjected to Physical Standard Test and Physical Efficiency Test, he was not declared disqualified which otherwise means that the petitioner stands qualified or else the respondents would have notified the same enabling the petitioner to prefer an appeal against his disqualification on physical ground.

3. Perusal of the record would show that the department themselves vide their correspondence dated 02.07.2021 have directed the petitioner to get in touch with the authorities at Bhopal for further processing of the claim of petitioner in terms of the representation that he has made particularly in respect of his claim so far as his height and chest measurement is concerned.

4. Given the fact that the respondents have already permitted the petitioner to make an appropriate correspondence with the authorities at Bhopal, it would not be proper for this Court at this juncture to issue any appropriate direction to the respondents. The right of the petitioner stands reserved for approaching the concerned authorities at Bhopal for ventilating his grievance. The authority concerned will consider the same on its own merits in accordance with the rules and

regulations and the guidelines governing the filed of recruitment to the post of Constable and take an appropriate decision at the earliest. It is expected that the respondents shall take an appropriate decision before the entire posts advertised are filled up.
