Order on Board By Prashant Kumar Mishra, J 19/07/2019

1. After disposal of the earlier petition in the nature of Habeas

CONT No. 501 of 2019 Corpus Mr. Mohd. Ibrahim Siddhiqui @ Aryan Arya, the petitioner therein, has moved before Hon'ble Supreme Court in SLP(Criminal) No.6710/2018. The said appeal was allowed on 27.08.2018. It is also revealed that fresh writ petition bearing WPCR No.69 of 2019 preferred by the petitioner is pending consideration in this Court before the appropriate Bench.

2. In this Contempt Petition the allegation is that without seeking permission from this Court the petitioner's daughter has again been admitted and lodged in Sakhi One Stop Center at Raipur. The said act of the administration is a fresh cause of action as on the earlier occasion the issue has already traveled to the Hon'ble Supreme Court and the order passed by this Court has merged in the final order passed by the Hon'ble Supreme Court. Since petitioner's fresh writ petition WPCR No.69 of 2019 is pending, in our considered opinion, no case for taking cognizance in the matter would arise. Accordingly, the Contempt Petition is dismissed.
