Learned counsel for the applicant submits that repeat application has been filed by the applicant as trial has not been completed and this Court granted liberty that in case, trial is not completed in 3 months, the applicant would be at liberty to revive the application. It is submitted that the applicant is in jail since 15/06/2021, till date trial has not been completed. Out of 25, only 8 witnesses have been examined. All the witness so far examined have turned hostile. Therefore, the applicant may be granted bail.

On the other hand, learned State counsel would submit that though out of 25, only 8 witnesses have been examined, other important witnesses particularly witness of seizure, blood stained axe from the applicant which is alleged to be used in committing murder is yet to be examined and FSL report has not been received.

Taking into consideration the submission of learned counsel for the parties, only on the ground of delay, this Court is not inclined to grant bail to the applicant as it is a case of allegation of murder.
