Heard on prayer for grant of leave to appeal. Taking into consideration the submission of learned State Counsel that in the report lodged immediately after the incident the accused persons were named and bloodstained soil, club, axe, clothes of the accused and clothes of the deceased which were seized during investigation all have been found to be stained with blood and the accused persons have failed to explain how bloodstain was found in their clothes, axe and club seized from their possession, we are inclined to grant leave to appeal. Application is allowed. Leave is granted.

Appeal filed by the State be registered as Acquittal Appeal and listed for further orders.
