The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.11/2016 registered in Police Station Utai, District Durg (C.G.) for offence punishable under section 304-B/34 of Indian Penal Code.

As per the prosecution case, a report was lodged by the mother of deceased that her daughter was subjected to cruelty for demand of dowry, therefore she committed suicide on 11/12/2015 that is within 7 years of marriage. According to the prosecution case, deceased Kavita Patel was married to Pawan Patel on 1/05/2015 and the death of both wife and husband was caused by committing suicide in suspicious circumstances. 3.
Learned counsel for the applicants submits that the applicants have not committed any crime and similarly placed co-accused Smt. Bodhani Bai has been enlarged on bail in M.Cr.C. No.3640/2016 on 14/07/2016 by
this court and case of the applicants is similar to that of the other coaccused who has been enlarted on bail, therefore the applicants may be released on bail.

Learned State counsel do not dispute the fact that case of the applicants is similar to that of the co-accused Smt. Bodhani Bai who has been enlarged on bail in M.Cr.C. No.3640/2016 on 14/07/2016. 5.
Considering the submission made by the State counsel and also for the fact that similarly placed co-accused Smt. Bodhani Bai has been enlarged on bail in M.Cr.C. No.3640/2016 on 14/07/2016, this court is inclined to release the applicants on bail.

Accordingly, the bail application is allowed and it is directed that the applicants shall be released on each of them furnishing personal bond for a sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of concerned trial court for their regular appearance before it as and when directed.
