Hon'ble Shri Justice Sanjay K. Agrawal Order On Board / 12 /201 (1) The petitioners seek to challenge the order dated 22.08.2014 passed by 6th Civil Judge, Class-I, Raipur in Civil Suit No.14-A/2008, by which the trial Court has declined to examine Record Keeper of the office of SubRegistrar, Raipur present in the Court on the ground that there is no order from the High Court in the earlier writ petition namely Writ Petition (227) No. 169 of 2012, in which this Court has only directed for examining the witnesses from the Chhattisgarh State Wakf Board and Municipal Corporation, Raipur.

(2) Since, this Court has allowed the petitioners' application to examine the defendants' evidence, the impugned order is set aside; and the trial Court is directed to permit the petitioner to examine his witnesses. (3) The petitioner is directed to appear before the trial Court on 21st December, 2016 along with all the private witnesses; and petitioner will pay process fee for issuing notice for appearance of official witnesses; and also serve humdust notice to the government officials; and they will be examined on 5th January, 2017. If the government officials are not served with the humdust notice; they will be further summoned and will be examined on 12 th January, 2017. Thereafter, the trial Court will consider and decide the suit after hearing both the parties till 31st March, 2017. It will be responsibility of

the petitioners to serve notice/summons to the respondents. (4) With the aforesaid observations, the writ petition is allowed to the extent indicated above subject to payment of cost of Rs.5,000/- payable to the respondents.
