The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.227/2014 registered in Police Station Baikunthpur, District Koriya for offence punishable under sections 3 and 7 of the Essential Commodities Act, 1955. 2.

As per the prosecution case, from the possession of the applicant 42 packets of Amrit Salt was recovered on 7/04/2014 which was meant for public distribution scheme. Thereby, offence is committed., 3.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case and he is in jail since 13/06/2016 and the incident is of year 2014 and all the evidence have been collected, therefore no investigation is required, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Considering the facts and circumstances of the case, degree of allegation, applicant is in jail since 13/06/2016, this court is inclined to

release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
