Agrawal Order On Board 2 8 /0 6 /201 (1) By this writ petition under Article 226 of the Constitution of India the petitioner has challenged the legality and propriety of the order dated 19.08.2010 passed by the Board of Revenue, Bilaspur in Appeal Case No. A/02/SA/B-105/74/2010 reversing the order dated 27.04.2010 passed by the Collector of Stamps, Bilaspur in Case No.70/B-105/2009-10.
(2) Learned counsel appearing for the parties frankly admit and submit that this case is squarely covered by the decision of this Court
passed in Writ Petition (Art. 227) No.285 of 2011 and other connected matters vide order dated 5.9.2011.
(3) I have heard learned counsel for the parties and perused the order impugned and order passed by the Collector of Stamps, Bilaspur. (4) In view of above, the writ petition is allowed. Order dated 19.08.2010 passed by the Board of Revenue, Bilaspur is hereby quashed. The case is remitted back to the Collector of Stamps, Bilaspur. The Collector of Stamps, Bilaspur after providing complete opportunity of hearing to the parties shall pass the order afresh. (5) Parties are directed to remain present before the Collector of Stamps, Bilaspur on 17th July, 2017. No order as to costs. Sd/- (Sanjay K. Agrawal) Judge D/-
