For Non-Applicant : Shri Ashutosh Pandey, Panel Lawyer Hon'ble Shri Justice Prashant Kumar Mishra 18/02/2015 The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.157/2012, registered in Police Station Ambikapur, District Surguja, for offence under Sections 395 and 397 of the IPC read with Sections 25 & 27 of the Arms Act. This is the 5th bail application under Section 439 CrPC. The first bail application was dismissed as withdrawn after arguing for some time. While deciding the 3rd bail application, this Court considered the merits of the case. The 4th bail application was filed on the ground that the applicant is suffering from Kidney, Stone and surgery is required. However, the said application was also rejected.

Learned State counsel would inform that the applicant has criminal antecedents.

Considering the gravity of the offence and antecedents, this Court is not inclined to release the applicant on bail. Accordingly, the application is rejected. However, the trial Court is directed to conclude the trial as early as possible.
