This is the second bail application preferred under Section 439 of the Cr.P.C. in connection with Crime No.232/2017 registered at Police Station Saraipali, District - Mahasamund (C.G.) for the offence punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act. The first bail application was dismissed as withdrawn. 2.

As per the prosecution story on 21.07.2017, on receiving a secret information from the informant, the police officials made a search in vehicle of the applicant bearing registration No. DL 04 CAV 4735 and seized 65 kilograms of Cannabis ('Ganja') from the illegal possession of the applicant.

Offence was registered and the applicant was taken into custody on 21.07.2017.

Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated in the present case. He further submits that the applicant is in custody since 21.07.2017, charge-sheet has already been filed and trial will likely to take some time, therefore, he prays for grant of bail to the applicant.

Per contra, learned counsel for the State opposes the bail application. 5.

I have heard learned counsel for both the parties and perused the casediary. 6.

Considering the facts and circumstances of the case also taking into account the nature of the offence alleged to have been committed and the period of detention, I am inclined to release the applicant on bail. 7.

Accordingly, the application for grant of bail is allowed. 8.

It is ordered that the applicant shall be released on bail on executing a personal bond for a sum of Rs.50,000/- with two sureties of Rs.25,000/- each in the like sum to the satisfaction of the concerned Trial Court. The applicant shall thereafter appear before the Trial Court on each and every date as are given to them by the said court.
