This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No. 93/2016 registered at Police Chowki Dashrangpur, P.S. Pipariya, Distt. Kabirdham (C.G.) for the offence punishable under Sections 457 and 380/34 of IPC. 2.
As per the case of the prosecution, on 18/04/2016 a report was made by the complainant that cash of Rs. 1200/-, samsung mobile and other articles were stolen by the applicant from his house and subsequently the applicant was arrested, and on his memorandum mobile phone and cash was recovered. 3.
Learned counsel for the applicant submits that the applicant has falsely been implicated in this case, he is in jail since 1/06/2016 and another co-accused i.e. Kamlesh has already been enlarged on bail in M.Cr.C. No. 4176/2016 dated 28/07/2016, therefore, he may also be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Considering the facts and circumstances of the case and particularly considering that the charge-sheet has been filed and another co-accused has already been enlarged on bail
by this Court, I am not inclined to release the present applicant on bail. 7.
Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed. 8.
It is directed that the applicant shall be released on bail on furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed. 9.
