The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.5085/2013 registered in Police Station Forest Range, Pasan, District Korba (C.G.) for offence punishable under sections 9, 51 of Wildlife Protection Act, 1972. 2.

As per the prosecution case, on 16/02/2016 one Sloth Bear (Bhalu) was found dead in the farm of one Devsingh. Arrow was found which was stuck on its head and due to that it died. Subsequently, applicant was arrested. After investigation it revealed that while grazing the field it was stuck by the arrow by the applicant.

Learned counsel for the applicant submits that applicant has been arrested after 2 1⁄2 months of the incident and on the memorandum and only on the presumption he has been arrested and the charge sheet has been filed. Therefore, learned counsel submits that the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Taking into facts and circumstances of the case and also for the fact

that charge sheet has been filed, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
