NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR WPS No. 4301 of 2018 Abdul Jahir S/o Abdul Gafur, aged about 64 years, retired Chainman, R/o Chatidih, Melapara, Irani Mohalla, Bilaspur, District Bilaspur (C.G.). ---Petitioner
Versus
1. State of Chhattisgarh, Through Secretary, Department of Urban Administration, Mahanadi Bhawan, Mantralaya, Naya Raipur, District Raipur (C.G.).
2. Director, Office of Urban Administration Raipur, District Raipur (C.G.).
3. Commissioner, Municipal Corporation Bilaspur, District Bilaspur (C.G.). ---Respondents For petitioner :
Shri Ajay Shrivastava, Advocate.
For State :
Ms.Pushpa Dwivedi, Advocate on behalf of Shri A.S.Kachhwaha, Addl.A.G.
Hon'ble Shri Justice P. Sam Koshy Order on Board 03/07/2018 1.
The grievance of the petitioner in the instant Writ Petition is that, the petitioner had retired from service on 31/07/2016 and though two years have been passed, the petitioner has till date not received any amount of retiral dues inclusive pensionary benefits.
2.
Given the limited nature of dispute, this Court does not intend to keep the Writ Petition pending, rather ends of justice would meet if the Writ Petition is disposed off with a direction to the respondent No.3 to ensure that the retiral dues and the pensionary benefits payable to the petitioner is processed and released to him (unless he is legally not entitled for the same) within a period of 60 days from today.
3.
It is made clear that, the petitioner would also be entitled for interest for the period from the date of his retirement till the date of payment is made @ 9% per annum.
4.
The Writ Petition accordingly stands allowed and disposed off. Sd/- (P. Sam Koshy) Sumit JUDGE
