Hon'ble Shri Justice P. Sam Koshy Order On Board 17.08.2021

1. The challenge in the present writ petition is to the order dated 05.04.2021 passed by the District Collector Koria, Baikunthpur.

2. Vide the impugned order, the appeal preferred by the petitioner has been rejected.

3. Prima facie, this Court is of the opinion that the order is one which is revisable before the Divisional Commissioner under Rule 5 of the Chhattisgarh Panchayats (Appeal and Revision) Rules, 1995.

4. Given the said fact that there is a remedy of revision available to the petitioner, the writ petition at this juncture is disposed of permitting the petitioner to avail the other remedies of revision before the Revisional Authority. In the event, if the petitioner prefers a revision, the Reivisional Authority is expected to take a decision on the Revision at the earliest in accordance with law.
