1. The grievance of the petitioner is the prolonged departmental enquiry pending against the petitioner.

2. According to the petitioner he was placed under suspension on 09.10.2009. Thereafter, he was issued with a charge sheet on 23.11.2009. To that said charge sheet the petitioner gave his reply on 15.12.2009 and thereafter there has not been any substantial progress in the departmental enquiry. Meanwhile, respondent authorities have revoked the order of suspension and taken him back in service vide order dated 31.03.2010.

Grievance of the petitioner now is that on account of non conclusion of the Departmental enquiry the petitioner is always being kept out of the promotional process which are initiated by the respondent authorities and which is causing considerable loss to the petitioner and he prays that respondents authorities may take all appropriate steps in ensuring that that departmental enquiry is concluded at the earliest.

4. Learned Additional AG appearing for the State submits that all efforts shall be made in getting the departmental enquiry concluded at the earliest.

5. Given the said submissions, the writ petition at this juncture stands disposed of directing the respondents to consider the take all necessary steps possible for early conclusion of the departmental enquiry. However, within the upper limit of 6 months from the date of receipt of copy of this order.

6. In case, if the respondents find it difficult in concluding the departmental enquiry for some reasons the authorities should take appropriate steps and pass an order dropping the proceedings, if circumstances is so made out.

7. The observation of this Court is only would come into force only if the departmental enquiry is pending and has not been concluded. 8.

With the aforesaid observations, the present writ petition stands disposed off.
