The present petition is against the order dated 04.05.2018 passed by the S.D.O. invoking jurisdiction under Section 144(1) of the Chhattisgarh Land Revenue Code, 1959.

Under Section 144(2)(i) of the Chhattisgarh Land Revenue Code, second appeal is provided to the Commissioner. In view of this, an alternative remedy is available, therefore, this Court is not inclined to exercise the jurisdiction under Article 227 of the Constitution. The petitioner shall be at liberty to file a suitable second appeal before the concerned authority as provided under the statute.

If the application for condonation of delay is filed along-with the appeal, the Commissioner may decide the same objectively considering the facts of this case.

With such observation, the petition stands disposed of. 5.
Certified copy of the impugned order be returned to the petitioner after retaining the photocopy of the same.
