1. The challenge in the present writ petition was to the issuance of the charge sheet and conducting of the departmental enquiry by the respondents.

2. The counsel appearing for the respondents submits that pending the petition before this Court, the respondents have already finalized the departmental enquiry, since there was no interim protection in favour of the petitioner and the petitioner has been found guilty in the departmental enquiry and he has also been inflicted with a punishment on 16.12.2015 and the said order of punishment is already under challenge before this Court in another writ petition i.e. WPS No. 847/2016.

3. This aspect is not disputed by the counsel for the petitioner.

4. Given the said fact, now that the departmental enquiry under challenge is already concluded and an order of punishment also has been passed, this Court is of the opinion that the petitioner, since he has challenged the subsequent development in a separate writ petition, the petitioner would have the liberty of taking the grounds that he has raised in the present writ petition also for challenging the punishment order as well as the departmental enquiry in the said writ petition.
