The grievance of the petitioner in the present writ petition is the inaction on the part of the respondents in not releasing the Tractor bearing registration No. CG 04/MD 1576 and Trolley bearing registration No. CG 04/MQ 4490, which is allegedly seized by the respondent No.2 in a forest case.

According to the petitioner, he has already approached the respondent No.2 and his application is pending, but till date no decision has been taken by the authorities. However, perusal of the record would show that no such copy of the application is enclosed along with the writ petition.

Given the said facts, the present writ petition at this juncture stands disposed of directing the petitioner to approach the respondent No.2

by way of a fresh application for release of the said vehicle on Supurdnama in accordance with the provisions of law and the said application shall be duly considered and decided by the concerned authority on its own merits at the earliest, preferably within a period of 45 days from the date the petitioner makes the fresh application, in case if the petitioner has already made an application and that application is already pending consideration before the authority concerned, then a fresh application need not be made. 4.

With the aforesaid observations, the present writ petition stands disposed of.
