The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.95/2016 registered in Police Station Jashpur, Distt. Jashpur for offence punishable under sections 363, 370/34 of Indian Penal Code.

As per the prosecution case, written report was made by Sushma Bhagat mother of the victim that her daughter is missing. Subsequently, on enquiry it was revealed that victim was taken by one Suman to Delhi wherein she was handed over to one Santosh who was running placement agency. Thereafter, the girl was made to do house hold job and thereby this applicant Dinesh Kumar Yadav who was working in placement agency of Santosh also committed offence alongwith other co-accused. 3.

Learned counsel for the applicant submits that the applicant has not committed any offence infact when report was made this applicant brought the girl back to her village Gumla and no offence has been committed by the applicant as the entire allegation have been attributed to Suman, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the statement of the girl under Section 161 and 164 of Cr.P.C. wherein it is stated that the applicant brought the girl back to her village Gumla. Considering the role played by the applicant and the nature of allegation, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
