The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.08/2016 registered in Police Station Station House Officer, Government Rail Police (G.R.P.) Bhilai, District Durg (C.G.) for offence punishable under section 20 (£) (2) (£) read with Section 8 of N.D.P.S. Act.

As per the prosecution case, on 13/01/2016 on a information received that the applicant is carrying illegal cannabis, raid was made and from the possession of the applicant in railway platform 9.500 kg cannabis were recovered.

Learned counsel for the applicant submits that the cannabis were not seized in person from the applicant and he further submits that officer who seized the cannabis was not authorized, therefore the applicant has been falsely implicated in the case and he may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the case diary and the documents. Prima facie it appears

from the possession of the applicant 9.500 kg cannabis were recovered. Considering the quantity of cannabis seized, this court is not inclined to release the applicant on bail.

Accordingly, the bail application is dismissed. Certified copy as per rules.
