The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.166/2016 registered in Police Station Kurud, District Dhamtari (C.G.) for offence punishable under section 354 of Indian Penal Code and Section 3(1)(xi) of Scheduled Caste & Scheduled Tribe (Prevention of Atrocities) Act. 2.

As per the prosecution case, on 18/04/2016 the victim was going to the shop, at that time applicant came there and thereafter tried to caught hold of the scarf (dupatta) and also tried to caught hold of the hand which was objected. Subsequently, again he tried to do it while she was returning from the shop to her house and it was reported to the police. 3.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case and considering the nature of allegation, no further investigation is required, charge sheet has been filed, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the statement of the victim. Considering her statement,

without further observation on the merits, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
