1. The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973 as he was arrested on 27.05.2021 in connection with Crime No. 98/2021 for offence under Sections 188, 269, 212, 216, 120(B) of the IPC and Section 03 of the Epidemic Act and Section 25 of the Arms Act, Section 05 of the Explosive Act, 1908, Section 9(b)(2) of the Explosive Substances Act, 1884 and Section 8(2) & 8(3) of the Chhattisgarh Public Security Act, registered at Police StationRajpur, District- Balrampur-Ramanujganj (C.G.).

2. At the outset, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file appropriate appeal.

3. Counsel for the State has no objection to the above prayer.

4. Permission granted.

5. Accordingly, the application is dismissed as withdrawn with the liberty as stated above.

6. Registry is directed to return certified copy of the impugned order to the counsel for the applicant on his furnishing true authenticated xerox of the same.
