For Non-Applicant : Shri Ravish Verma, Govt. Advocate. Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 17/12/2020 :

1. The applicant has preferred this application for grant of anticipatory bail as he apprehends his arrest in connection with Crime No.63/2020, registered at Police Station Kunkuri District Jashpur for offence punishable under Section 120-B and 420 of the IPC.

2. The applicant being the Branch Manager of Shri Ram Finance Company sanctioned loan of Rs.8 lakhs in favour of Subhash Gupta showing him to be the Proprietor of Rahul Enterprises. For obtaining loan Subhash Gupta mortgaged and hypothicated the shop and articles. However, on default of repayment of loan, during verification, it was found that there is no such shop in the name of Rahul Enterprises and Subhash Gupta is not the owner of the mortgaged shop.

3. Considering the nature of allegations and seriousness of offence, I am not inclined to release the applicant on anticipatory bail. Accordingly, the application is rejected.
