Hon'ble Shri Justice Goutam Bhaduri Order on Board 29.09.2021 Heard

1. The only grievance of the petitioner is that in a proceeding under Section 115 and 116 of the Land Revenue Code, at the behest of the petitioner, initial order was passed in his favour. Subsequently, it was challenged by the respondent before the SDO and the SDO has set aside the order of Tahsildar dated 27.05.2017 against the said order an appeal has been filed on 13.04.2018 before the Commissioner. He further submits that before

Commissioner no proceeding has been taken place and case is adjourned from time to time, therefore direction may be issued to decide the appeal within a specified time.

2. Perused the documents.

3. Perusal of order sheet appeal memo would show that the appeal was filed on 13.04.2018, thereafter no substantial proceedings has been taken place and only adjournment has been granted. Taking into such fact, the Commissioner Bilaspur is directed to decide the appeal filed by the petitioner within 4 months from the date of receipt of a copy of this order.
