Ignoring the defaults pointed out by the Office in the present Writ Petition, the matter was finally heard at admission stage itself with the consent of learned Counsels for the parties.

The limited relief that Petitioner is seeking in the present Writ Petition is for an appropriate direction to Respondent No.2 to consider the claim of Petitioner seeking for promotion ahead of the private Respondent No.3.

Learned Counsel for Petitioner submits that the Petitioner is senior to Respondent No.3 in service and she is eligible for promotion, however, her claim has been ignored and the said private Respondent has been promoted ahead of her. He further submits that the Petitioner has made a detailed representation to Respondent No.2 but till date the same is pending and therefore prays for an appropriate adjudication on the same at the earliest.

The limited prayer of Petitioner is not opposed by learned Government Advocate appearing for Respondents No.1 & 2. 5.

Accordingly, the present Writ Petition is disposed of directing the Respondent No.2 to consider and decide the representation of Petitioner on its own merits, in accordance with the service rules governing the field. 6.

Let a decision in this regard be taken by Respondent No.2 at the earliest, preferably within a period of 60 days from the date of receipt of copy of this Order.

It is made clear that this Court has not expressed any opinion on the merits of the case. Respondent No.2 shall decide the claim of Petitioner strictly in accordance with law.
