(2) This is the third bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.382/2012 registered at Police Station Pulgaon, District Durg, for the offence punishable under Sections 420/34 of the Indian Penal Code. (3) The first and second bail applications of the applicants were dismissed on merits by order of this Court dated 15.09.2015 & 26.02.2016 passed in M.Cr.C. No.4711/2015 & M.Cr.C. No.1427/2016, respectively.

(4) After hearing learned counsel appearing for the parties and taking into consideration the totality of the facts and circumstances of the case, I do not consider it a fit case to entertain this third bail application. Consequently, the third bail application is rejected. However, the trial Court is directed to expedite the trial and conclude the same as early as possible. (5) Certified copy as per rules.
