Learned counsel for the State submits that he could not pay process fee in time. He submits that there is delay of only 24 days therefore delay may be condoned. On due consideration, for the reasons assigned in I.A. No. 1/15, the same is allowed. Delay in filing the Cr.M.P. is condoned.
Also heard on CR.M.P. for leave to appeal followed by acquittal appeal preferred against the judgment dated 17-112014 passed by the Additional Sessions Judge (FTC) Bastar at Jagdalpur/Special Judge under Protection of Children from Sexual Offences Act, 2012. Vide impugned judgment the trial Court acquitted the respondent for the offences for which charge was framed.
Perused the judgment impugned and other documents. In the considered view of this Court, it is a fit case where leave to appeal may be granted. Consequently, instant Cr.M.P. is allowed.
List the matter under the head of acquittal appeal immediately service is complete.
