Hon'ble Shri Justice T. P. Sharma Hon'ble Shri Justice Inder Singh Uboweja Order on Board by T.P.Sharma, J.

05/05/2015 1.

This is an appeal against the judgment of acquittal dated 14.10.2014 passed by the Additional Sessions Judge (F.T.C.), Surguja (Ambikapur) in Sessions Trial No.40/2014 whereby the trial Court has acquitted respondent No.2 of the charge under Section 363, 366, 376 and 506-B of the I.P.C. and Section 4 of Protection of Children from Sexual Offences Act, 2012.

2.

We have heard learned counsel for the appellant. 3.

Copy of statement of witnesses, especially, the copy of statement of P.W.2 prosecutrix is perused. Virtually, this is a case of no evidence, in which, no option except to acquit respondent No.2 is left to the Court below. 4.

Consequently, we do not find any scope of interference in this appeal. This appeal, being devoid of merit and substance, is dismissed summarily. (T.P.Sharma) (I.S.Uboweja) JUDGE JUDGE Anjani
