1. The limited prayer that the petitioner at this juncture makes is that the petition may be disposed of with a direction to the respondents to consider his representation claiming promotion to the post of Teacher (Nagriya Nikay).

2. The contention of the petitioner is that, since the petitioner has completed the requisite length of service for promotion to the post of Teacher (Nagriya Nikay), his case should be considered by the respondents.

3. The counsel for the State at this juncture submits that as per the instructions there appears to be some ban on the promotion issued by the State Govt. and moreover the State Govt. is also absorbing the Teachers of the Panchayat as well as Nagriya Nikay in the Education Department and for this reason also the promotion process is not being initiated.

4. Given the aforesaid facts and circumstances of the case, the writ petition stands disposed of with a directiont to the respondent No.3 to take

-2appropriate decision at the earliest on the representation that the petitioner has made in accordance with rules, regulations and also policy of the State Govt. issued from time to time so far as promotion is concerned.
