1. The applicant has preferred this third bail application under Section 439 of Cr.P.C. as he is in jail since 10.11.2020 in connection with Crime No. 312/2020 registered in Police Station- Sakri, District Bilaspur (CG) for the offence punishable under Sections 376 (d) & 506 of IPC.

2. The first bail application of the applicant was dismissed on merits by this Court vide order dated 27.01.2021 passed in M.Cr.C. No. 9126 of 2020. Thereafter, the applicant preferred the second bail application which was also dismissed as withdrawn vide order dated 12.07.2021 passed in M.Cr.C. No. 3207 of 2021.

3. Learned counsel for the applicant seeks to withdraw this third bail application with liberty to file a fresh application as and when occasion arises.

4. Accordingly, this third bail application is dismissed as withdrawn with the liberty as stated above.
