1. The applicant has preferred this first bail application under Section 439 of Cr.P.C. as he is in jail since 27.05.2021 in connection with Crime No. 219/2021 registered in Police Station- Outpost Tumdibod, P.S. Lalbag, District Rajnandgaon (CG) for the offence punishable under Sections 436, 294 & 429 of IPC.

2. After arguing for some time, learned counsel for the applicant seeks to withdraw this bail application with liberty to file a fresh application as and when occasion arises.

3. Accordingly, the bail application is dismissed as withdrawn with the liberty as stated above.
