Hon'ble Shri Justice Pritinker Diwaker Order On Board 26/11/2015

1. By this revision the petitioner has impugned the order dated 17.3.2015 passed by the 2nd Additional Sessions Judge, Korba in Criminal Case No.19/15 framing charge against the applicants under Section 304 (B) read with Section 34 of the Indian Penal Code, 1860.

2. After arguing at length, counsel for the applicants seeks to withdraw this revision with liberty to raise all the grounds as raised in this revision before the Court below at appropriate stage. However, he prays that since the trial is pending before the Court below for the last eight months, a direction for expeditious disposal of trial may be issued.

3. The State counsel has no objection to the proposition as put forth by the applicants.

4. Accordingly, the revision is dismissed as withdrawn with liberty as prayed for.

5. Needless to state that the trial Court shall make all the endeavours for expeditious disposal of trial.
