The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 15/2016 registered in Police Station Central Crime Squad Ganj, Raipur, Distt. Raipur (C.G.). for offence punishable under section 41 (1+4), 454, 457, 380/34 of Indian Penal Code.

As per the prosecution case, the applicant was driver in vehicle bearing No. MP 50-BC-0594 and on 30/06/2016 the vehicle was intercepted and LED, computer and ornaments were found and subsequently on investigation it was found that the applicant alongwith other co-accused they committed theft at Birsa District Balaghat, Singhora District Shivni and kept stolen goods at different places and at the instance of this applicant and the other co-accused on their memorandum total 7 LED, 4 computer, inverter were recovered. 3.
Learned counsel for the applicant submits that all the allegations have been attributed to the other co-accused and the applicant has not
committed any offence and he has been falsely implicated, therefore, the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Perused the case diary and the documents as also recovery. At the instance of the applicant the stolen articles i.e. watch was recovered. Memorandum shows that from the different places the theft was committed by the applicant and the other co-accused which is supported by recovery. Taking into facts of the case, this court is not inclined to release the applicant on bail.

Accordingly, the bail application is dismissed. Certified copy as per rules.
