The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.79/2015 registered in Police Station Duldula, District Jaspur (C.G.) for offence punishable under sections 409, 420, 467, 471 R/w 34 of Indian Penal Code. 2.
As per the prosecution case, the applicant No.1 is the Sarpanch and applicant No.2 is the Secretary of Fair Price Shop which was being run at village Bhusditoli wherein the applicants have misappropriated 98.91 quintals of rice, 2.90 quintals of sugar, 5.80 quintals of gram amounting to Rs.2,80,000/- which was meant for public distribution. 3.
Learned counsel for the applicants submits that the charge sheet has been filed infact 13 cards were in double and one was triple for which distribution was not made which was held by single person and the applicants have been falsely implicated. He further submits that charge sheet has been filed, they are in jail since 29/03/2016, no further
investigation is necessary, therefore the applicants may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
Considering the facts and circumstances of the case, charge sheet has been filed, offences are triable by JMFC, applicants are in jail since 29/03/2016, this court is inclined to release the applicants on bail. 6.
Accordingly, the bail application is allowed and it is directed that the applicants shall be released on each of them furnishing personal bond for a sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of concerned trial court for their regular appearance before it as and when directed.
