1. Learned counsel for the petitioner would submit that the petitioner was granted compassionate appointment on the post of contingency paid Dak Runner on 10.9.99 despite the fact that under the State Government's circular dated 6.7.2007, such appointment has to be made

on regular post and not on contingency post.

2. Learned counsel for the petitioner would submit that for the present the petitioner may be permitted to prefer a representation for grant of benefit of regular pay scale from the date of initial appointment.

3. In view of the above, the writ petition is disposed of with a direction that if the petitioner prefers a representation before the competent authority within a period of three weeks from today, the said authority shall decide the petitioner's representation keeping in view the State Government's circular dated 6th July, 2007, as early as possible, preferably within a period of three months from the date of presentation of representation.
