1. The present writ petition is filed against the alleged inaction on the part of the respondents in not issuance of a permanent social caste certificate to the petitioner.

2. According to the petitioner, he belongs to Scheduled Caste Mahar community and he has preferred an application before the respondent No.2 on 04.04.2019 and again on 23.12.2019 for issuance of a permanent social status caste certificate. However, till date the said application has not been decided by the respondent No.2. The counsel for the petitioner submits that he has already submitted documents even prior to 1950 with which his social status can be determined by the respondent No.2. He also submits that the State Govt. has itself enacted a rule in this regard which is known as Chhattisgarh Scheduled Caste, Scheduled Tribe and Other Backward Classes (Regulation of Social Status Certification) Rules, 2013 (in short, the Rules, 2013). The said Rule specifically lays down the

-2procedure to be adopted by the authorities while considering the application for issuance of caste certificate.

3. The State counsel at this juncture submits that the matter may be disposed of for the authorities to take an appropriate decision accordance with Rules, 2013.

4. Given the said submissions by the counsel for the either side and on perusal of the records, the writ petition stands disposed of directing the respondent No.2 to duly verify the application filed by the petitioner for grant of caste certificate at the earliest in accordance with rules governing the field particularly Rules, 2013 and an appropriate decision be taken on the application within a period of three months from the date of receipt of copy of this order.
