1. Heard.

2. The applicant has preferred this first bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.90/2020, registered at Police Station Darima, District Surguja (CG), for the offence punishable under Section 306 of the Indian Penal Code.

3. Applicant has allegedly abetted the deceased in commission of suicide.

4. Applicant was married with the deceased about 10 years back. It is alleged that the applicant used to raise quarrel on trivial

issues and was in the habit of assaulting the deceased in a state of intoxication for which the deceased was mentally perturbed and set herself ablaze on 3-3-2020.

5. Learned counsel for the State, per contra, would oppose the bail application.

6. Considering the nature of allegations and for the fact that there is no allegation of commission of cruelty for demand of dowry and there is no allegation of any overt act on the date of incident also as also for the fact that the applicant is in jail since 13-8-2020 and further considering the fact that the charge sheet has already been filed, I am of the opinion that present is a fit case to release the applicant on regular bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
