The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.240/2016 registered in Police Station Tikrapara Raipur, Distt. Raipur (C.G.) for offence punishable under sections 452, 294, 506, 323, 427, 34 of Indian Penal Code. 2.

As per the prosecution case, on 19/06/2016 the applicant alongwith other three co-accused persons went to the Petrol Pump at about 1 am and thereafter some altercation took place and the applicant forcefully entered into the cabin and assaulted the employees of the Petrol Pump. 3.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case and he has not taken any part in assault. He submits that similarly placed co-accused have been enlarged on bail by this court in M.Cr.C. No.4648/2016 on 17/08/2016 and case of the present applicant is similar to that of the person who have been enlarged on bail, therefore the applicant may be released on bail. 4.

Learned State counsel do not dispute the fact that similarly placed co-accused have been enlarged on bail by this court in M.Cr.C.

No.4648/2016 on 17/08/2016.

Considering the facts and circumstances of the case and also for the fact that similarly placed co-accused have been enlarged on bail by this court in M.Cr.C. No.4648/2016 on 17/08/2016, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
