WPCR No. 379 of 2019 24/06/2019
1. Admittedly, the petitioner was arrested for having committed an offence punishable under Section 376 of I.P.C wherein he has been enlarged on bail in MCRC No. 378 of 2018, thus, it is not correct on the part of the petitioner to apprehend that he would be arrested for the same offence again. If the petitioner is arrested for commission of some other offence, Writ Court would not issue an anticipatory direction for not arresting the petitioner for any other offence.
2. If on the report of the prosecutrix an offence has been registered and the same is published in the news paper the same would amount to publication of a news which is factually incorrect.
3. The kind of direction sought for by the petitioner in this Writ Petition cannot be issued in a blanket manner. There is no substance in the present Writ Petition, the same deserves to be and is hereby dismissed.
