(2) This is the third bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.32/2015 registered at Police Station Gharghoda, District Raigarh, for the offence punishable under Sections 354(A), 506, 323 of the Indian Penal Code and Section 8 of POCSO Act.
(3) The applicant's first bail application was dismissed on merits by order of this Court dated 02.03.2015 passed in M.Cr.C. No. 920/2015 and second bail application was also dismissed on merits by order of
this Court dated 27.08.2015 passed in M.Cr.C. No.4547/2015. (4) After hearing learned counsel appearing for the parties and taking into consideration the totality of the facts and circumstances of the case, I do not consider it a fit case to entertain the third bail application. Consequently, the third bail application is rejected. However, the trial Court is directed to expedite the trial as early as possible.
