1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.259/2014 {S.T. No.14/2015 pending in the Court of Additional Sessions Judge (FTC), Ambikapur}, registered at Police Station Gandhinagar, Distt. Surguja for the offence punishable under Sections 363 and 366A read with Section 34 of the IPC.

2. It is the case of the prosecution that the applicant and other co-accused have abducted / kidnapped one Om Prakash, aged 5 years, on 2-122014 for ransom.

3. Learned counsel for the applicant submitted that the applicant has not

committed any offence and has been falsely implicated, his identity is not established, charge-sheet has already been filed and no useful purpose will be served by detaining him in jail.

4. Learned State counsel submits that the applicant has criminal antecedents for the offence punishable under Section 365 read with Section 34 of the IPC.

5. Taking into account the nature and gravity of offence, previous criminal antecedents of the applicant for the offence punishable under Section 365 of the IPC and material collected by the prosecution, I am not inclined to grant bail to the applicant. The bail application is, therefore, rejected.
