21.09.2020 Heard 1.

Learned counsel for the petitioner submits that the petitioner is at the fag end of his service career, aged about 60 years and he has been transferred from Ratanpur Range, Bilaspur Forest Division to Dharamjaigarh Forest Division. He would submit that the petitioner is a patient of B.P. & Sugar and he is being treated and Dharamjaigarh is directly not connected with the Train. He would further submit that the transfer has been made only to accommodate the respondent No.4, Lakhe Ram Dhruw and according to the policy of the State, at the fag end of service career, normally transfer is not effected. He further submits that during the pandemic period, the

petitioner may not be transferred as it may fatal to his life being the patient of Diabetes & Hypertension. He further submits that the petitioner has already made a representation by Annexure P-2 to the Principal Chief Conservator of Forest, which may kindly be directed to be decided. 2.

On the other hand, learned State counsel opposes the argument. 3.

Perused the documents and medical certificate. Specially taking into age and ailment of the petitioner during pandemic as petitioner is said to be diabetic, the respondent No.2 is directed to decide the representation of the petitioner Annexure P-2 within a further period of 60 days from the date of receipt of a copy of this order. Till the representation is decided, the transfer order dated 20.08.2020 (Annexure P-1) in respect of the petitioner shall not be given effect to.

With the aforesaid observation/direction, the writ petition stands disposed off.
