The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.148/2020 registered in Police Station Kabir Nagar, Distt. Raipur (C.G.) for offence punishable under sections 408, 34 of I.P.C.

As per the prosecution case, while the applicant was working in the government liquor shop he embezzled an amount of Rs.16,36,520/-. 3.

Learned counsel for the applicant submits that the applicant is a labourer and he is not a clerk to the shop and the cheque were obtained from the applicant for which proceeding under Section 138 of NI Act are being taken against the applicant. He submits that the applicant is in jail since 26/08/2020. He submits that one of the co-accused has been enlarged on bail by the coordinate bench vide M.Cr.C. No.6457/2020 on 6/11/2020, therefore the applicant may also be released on bail. 4.

Learned State counsel is not able to dispute the fact that co-accused has been enlarged on bail.

Considering the facts and circumstances of the case, charge sheet

has been filed and also for the fact that co-accused has been enlarged on bail by the coordinate bench vide M.Cr.C. No.6457/2020, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
