1. The present Criminal Revision has been preferred against rejection of the Application under Section 311 of the Cr.P.C. moved by the Applicant before the Trial Court vide order dated 08.08.2016 in Criminal Case No. 121/2016.

2. A perusal of the impugned order dated 08.08.2016 clearly reflects that the Court below considering the Application under Section 311 of the Cr.P.C. did not find any substantive ground made in the said Application under Section 311 of the Cr.P.C. The Applicant along with the present Revision has also enclosed the application that he had moved before the Court below under Section 311 of the Cr.P.C.

3. A perusal of the application reveals that the Applicant has not been

able to bring any new facts and grounds other than what was available at the time of recording of the evidence of the Prosecutrix and prosecution witnesses.

4. In the absence of any cogent and substantive ground raised in the application submitted before the Trial Court, this Court is of the opinion that no infirmity or illegality has been committed by the Court below while rejecting the said application.

5. Accordingly the Criminal Revision being devoid of merits, the same is dismissed.
